At the close of the 2022 General Assembly, two Juvenile Justice Reform bills were enacted, and one related to restrictive housing...
As part of a larger effort to address issues of racial justice, we are supporting measures for Criminal Justice Reform and Police Accountability. As bills are introduced, we will provide bill numbers and links to the actual bill text.
Objectives for 2022:
Criminal Justice had a breakthrough vote during the Special General Assembly Session in December 2021, when the Governor's veto of SB 202 - The Lifers with Parole bill was overridden. This bill had been proposed for years with various revisions, but finally the governor will not be able to override a Parole Commission decision to grant parole to those who are deemed qualified. Now, only two other states continue to use this process!
HB 67 - Correctional Services - Step-Down Programs - Cause of Action
Again we will be addressing a restrictive housing (solitary confinement) bill which did not get out of committee in 2021 but has strong backing. Currently a person who is placed in solitary confinement may be released directly to the community without any transitional period to prepare. In past years 200-300 people per year were released directly into the community from restrictive housing, a situation that is unsafe for the returning citizen and for the community. The proposed "direct release" bill prohibits release without specific prior preparation and evaluation.
HB 25 - Rehabilitation and Education for All Prisons (REAP) Act
A “smart about crime bill” that calls for our State Department of Education and Department of Human Services to work together to establish correctional rehabilitation and educational programs and work in relationship between higher-level Maryland colleges and prisons. The Department is charged to work with the inmates to access Federal Grants in connection with Md colleges. Accountability, reporting and tracking methods will be included in gathering data.
HB 459 / SB 691-- Juvenile Justice Reform
The Head of the House Judiciary Committee (Delegate Clippinger) introduced this bill to reform the Juvenile Justice System, this bill will limit the practice of automatically charging children as adults for many crimes. HB 459 retains the practice of automatically charging children in adult court for the most serious and violent crimes, but it requires a more considered approach to others and creating opportunities for informal adjustment before a child is charged. The bill also calls for the involvement of the Departments of Human and Juvenile Services and when appropriate, health, mental health, and educational services will be a part of the planning for a child’s case.
These changes are especially needed in light of the disproportionate impact of current policies on communities of color: 80% of those automatically charged as adults are Black, yet only about 10% of the juveniles charged as adults are ultimately convicted. Automatic transfer to adult court doesn’t usually result in convictions, it keeps Black children in detention and takes them out of consideration for any services that could provide rehabilitation or treatment and prevent future unlawful conduct.
HB 269/SB 53 Juvenile Law - Juvenile Interrogation Protection Act -
Requires parents to be present when a juvenile is being interrogated. There are cases where juveniles “confess” under stress and do not receive a fair trail. Other bills that will be considered are aimed at reducing the near-automatic referral of juveniles to adult criminal courts for trial.
We hope to be working on a bill related to "Felony Murder." Currently, if a person is actively engaged with others in a crime (robbery, theft, etc.) and one of them kills another person, everyone who is a part of the group can receive a first degree murder sentence. We believe that each person should be sentenced for only their own actions, not those of an accomplice.
Again racial justice impact statements will be made on certain criminal justice bills which we hope will help to reduce Maryland’s huge racial disparity in our prisons’ black population, the highest in the country!
